Terms & Conditions for Appointment of Channel Partner:
1. Channel Partner registration provide this form is mandatory before submission of invoice to Yogesh Enterprises.
2. Individual Channel Partners face to face meeting with authorized person of Yogesh Enterprises is
Mandatory .
3. For Domestic Channel Partners: At the time of registration/ appointment of Channel Partner MahaRera No., PAN card and GST no. is mandatory, if GST no. is not provided, the same will not be reimbursed. The following documents are also required
§ Proprietorship – Trade License, PAN
§ Partnership – Partnership Deed, Trade
§ License, PAN c. Pvt. Ltd. and Ltd.
§ Board Resolution, MOA, PAN
4. The documents for non-deduction of taxes, if any, as per Double Taxation Avoidance Agreement (DTAA) have to be provided by them or else applicable taxes shall be deducted as per the prevailing Indian Taxation laws.
5. Authorization/appointment and cancellation of Channel Partner shall be at the sole discretion of Yogesh Enterprises and or its subsidiaries, sister concerns (may change project to project).
6. Booking of a Unit/Flat through a Channel Partner will be recognized only if
a. An authorized representative of the Channel Partner accompanies the client during their 1st visit at sales office.
b. Channel Partner must ensure that the customer acknowledges in writing the channel partner’s name & intermediary role on the Booking Form.
7. Commission: 2% on Basic value for all Bookings in respect of all the projects present as well as future upcoming projects of the company
Note: For CP, All bookings should be taking on or above given bottom price by yogesh enterprises.
8. TDS will be deducted as per applicable rules and regulations, certificate for the same will be provided.
9. Commission/brokerage can be claimed by the Channel Partner through an invoice duly signed and stamped by the Authorized Signatories which is commensurate with the Channel Partner Registration Form. Any change in the list of Authorized Signatories need to be intimated to Yogesh Enterprises in writing immediately. The invoice needs to be raised on the letterhead of the Registered Entity only.
10. In the event that the customer cancels or terminates the agreement of sale/allotment letter to purchase the residence/s the company, Company is not liable to release any commission to Channel Partner
11. Brokerage payment will be made in favour of the registered name of the channel partner as per the company records.
12. The Channel Partner cannot share any pricing details on the behalf of the Company in writing with the client nor can send any email regarding the same. In the event of case any discrepancies, the Yogesh Enterprises will take preventive action against the Channel Partner.
13. The Channel partner is responsible for ensuring that All Documents like Signed Application Form, Attested KYC Documents, Attested copies of Unit Layout and Payment schedule etc. is provided to Yogesh Enterprises within seven working days, post the commercial closure.
14. Project pricing at any time is at sole discretion of Yogesh Enterprises which has the right to Increase or Decrease the pricing without any prior notice. Yogesh Enterprises will publish such pricing information from time to time as and when required.
15. The channel partner is aware that the services provided by the channel partner are in nature of Real Estate Agent services and would be liable for service tax in India as they are in connection with properties located within India.
16. For sourcing of business, the channel partner in no way will pretend or convey in any way that he/she is representing Yogesh Enterprises or is organizing, participating and conducting any event, exhibition, sales activity whether in Mumbai, Outstation and within India
17. The customer will reserve the paramount right to retain or change channel partner at any point during the sale process.
18. Breach of any of the above terms and conditions would lead to forfeiture of any unpaid commission and entitle Yogesh Enterprises to take necessary action as it may deem fit. This agreement will be governed as per Law of India. Any dispute shall be subject to exclusive jurisdiction of the courts of pune.
